Hudson Valley, NY Probate Litigation Lawyer
Assisting Clients in Rockland County and Throughout New York
There’s often someone unhappy with the will. In some cases, there is a legitimate reason to suspect foul play. In other cases, the estate must be defended against spurious claims by a disinherited relative.
The Law Offices of Robert S. Lewis, P.C. represents the estate, an individual beneficiary, omitted heirs or executors in probate litigation over estate administration or authenticity of the will. Located in Nyack, New York, we practice in Rockland County, Orange County, and surrounding jurisdictions of the Lower Hudson Valley. Call 845-358-7100 for a free consultation.
Contested Will
In a will contest, one or more parties contend that the will is invalid on the basis of:
- Undue Influence or Fraud — Someone close to the deceased convinced him or her to alter the will to their benefit, or falsified the document.
- Testamentary Capacity — The deceased lacked the mental awareness to draft and sign the will.
- Due Execution — The estate plan was improperly signed, witnessed or notarized.
- Missing Assets — Family members demand an accounting of the estate in the belief that some assets were left out of the will and presumably misappropriated.
Breach of Fiduciary Duty
Probate litigation sometimes hinges on allegations that the executor or personal representative stole assets, prolonged the settlement of the estate or bungled administrative duties such as liquidating assets or distributing the estate. Mr. Lewis can represent the estate or the fiduciary in these disputes.
If you are convinced the will is invalid or that there was an injustice in probating the estate, contact our Nyack office to discuss your concerns in a free initial consultation. Trial lawyer Robert S. Lewis brings 35-plus years of experience in probate litigation and estate administration law.
